General Terms and Conditions of Sale

Maison Marlaie reseller portal. Sales reserved for trade professionals.

1. Purpose and scope

These general terms and conditions of sale govern sales of Maison Marlaie products concluded on the online reseller portal, between Maison Marlaie and its professional customers (resellers, hotels, guest houses, yachts, concierge services, laundries and other establishments). Any order implies unreserved acceptance of these terms, which prevail over any purchasing conditions of the customer.

2. Seller

Maison Marlaie, SASU with share capital of EUR 2,000, registered with the Antibes Trade and Companies Register under SIRET 834 927 626 00012, intra-Community VAT FR02834927626. Registered office: 662 avenue Jules Grec, 06600 Antibes, France. Contact: contact@maison-marlaie.fr, 07 80 90 66 79.

3. Products

The products offered are Maison Marlaie laundry care products (detergents and fabric softener), made in Italy, in the formats presented on the online portal (1L per case, Discovery Pack, 5L, 15L and 25L containers). Images are non-contractual. Maison Marlaie reserves the right to modify its range.

4. Orders

Access to the catalogue and reseller pricing is reserved for professionals holding an approved account. Orders are placed directly from the online portal. An order becomes firm upon validation of payment. Maison Marlaie reserves the right to refuse any order for legitimate reason.

5. Prices

Prices are shown in euros, excluding tax (HT), ex-works, and do not include delivery charges. Volume-based tiered pricing applies automatically according to the quantities ordered. The prices in force are those displayed at the time of the order. Maison Marlaie reserves the right to change them at any time; the applicable prices are those in force on the day of the order.

6. Delivery charges

Delivery is free of charge for orders of EUR 400 excl. tax or more on cases of 12 bottles, and from EUR 500 excl. tax on containers. Below the free-delivery threshold, shipping is invoiced according to the order and the delivery region, at cost, and appears on the final invoice. Delivery is free in the Alpes-Maritimes (06) and Var (83) departments, hand-delivered, whatever the order amount.

7. Payment

Payment is made by bank transfer, using the details provided at the time of the order, with the order reference stated in the payment description. Unless specific terms have been agreed for an open account, the order is shipped after receipt of payment. Any late payment automatically incurs penalties at the legal rate in force, together with a flat-rate recovery indemnity of EUR 40.

8. Delivery

Orders are shipped within 48 working hours of payment confirmation, subject to availability. Delivery times are given for guidance only. Transfer of risk takes place when the products are handed over to the carrier. The customer checks the condition of the products on receipt and files any reservations with the carrier.

9. Retention of title

The products remain the property of Maison Marlaie until full payment of the price, principal and incidental. Transfer of risk nevertheless takes place upon delivery.

10. Claims and returns

Any claim relating to a non-compliant or damaged product must be made in writing to contact@maison-marlaie.fr within 8 days of receipt, together with supporting documents. No return is accepted without the prior agreement of Maison Marlaie.

11. Liability

The products are intended for professional use in accordance with their purpose and with the instructions shown on the labels. Maison Marlaie cannot be held liable in the event of improper use. The formulation is classified H412; the precautions for use must be observed.

12. Personal data

The data collected are necessary for processing orders and for the commercial relationship. In accordance with the GDPR, the customer has a right of access, rectification and deletion, exercisable at contact@maison-marlaie.fr.

13. Governing law and disputes

These terms are governed by French law. In the event of a dispute, and failing amicable resolution, jurisdiction is granted to the competent courts of the district of Maison Marlaie's registered office.
